End User License Agreement

This End User License Agreement (hereinafter referred to as "Agreement") is entered into between Course Kit Pty Ltd (hereinafter referred to as "Licensor") and the end user (hereinafter referred to as "Licensee") of the installed Course Kit Pty Ltd apps. By using any Course Kit Pty Ltd app, the Licensee agrees to be bound by the terms and conditions set forth in this Agreement.

1. Compliance with Standard Terms and Conditions

The Licensee acknowledges and agrees that all Course Kit Pty Ltd apps comply with the standard terms and conditions established by the Licensor. The Licensee further agrees that the Atlassian Marketplace Terms of Use will apply to the use of the installed Course Kit Pty Ltd apps.

2. Grant of License

Subject to the terms and conditions of this Agreement, the Licensor hereby grants the Licensee a non-exclusive, non-transferable license to use the Course Kit Pty Ltd apps in accordance with the applicable terms and conditions specified by the Licensor and the Atlassian Marketplace Terms of Use.

3. Restrictions

The Licensee shall not, directly or indirectly, do any of the following without the prior written consent of the Licensor:

1. Modify, adapt, translate, or create derivative works based on the Course Kit Pty Ltd apps.
2. Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Course Kit Pty Ltd apps.
3. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Course Kit Pty Ltd apps.
4. Use the Course Kit Pty Ltd apps for any unlawful or unauthorized purpose, or in any manner that could damage, disable, overburden, or impair the functionality of the apps.

4. Intellectual Property

The Licensee acknowledges that the Course Kit Pty Ltd apps, including but not limited to any copyrights, trademarks, trade secrets, patents, and other intellectual property rights associated with the apps, are the sole property of the Licensor. The Licensee shall not acquire any ownership rights or interests in the Course Kit Pty Ltd apps, except for the limited license granted under this Agreement.

5. Termination

The Licensor reserves the right to terminate this Agreement and the Licensee's access to and use of the Course Kit Pty Ltd apps, with or without cause, at any time and without prior notice. Upon termination, the Licensee shall cease all use of the apps and promptly uninstall and remove them from all devices.

6. Limitation of Liability

In no event shall the Licensor be liable to the Licensee or any third party for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with the use of the Course Kit Pty Ltd apps.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Licensor is located. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

8. Entire Agreement

This Agreement constitutes the entire agreement between the Licensor and the Licensee concerning the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.

9. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect.

By using any Course Kit Pty Ltd app, the Licensee acknowledges and agrees to be bound by the terms and conditions set forth in this Agreement.
